POLITICS VS LAW
STRIKING THE DIFFERENCE

Inasmuch as the independence of the judiciary have once again been proved against the traditional Nigerian Who-Knows-Who and money syndrome politics, crucial issues should be understood to set the record straight and give strength to posterity, instead of propagating sycophancy to gain cheap favors in the political circles.

The question “Has Andy Uba been a governor of Anambra state?” is pertinent as the judiciary may be faced with a legal suit come 2010 i.e. the end of Peter Obi’s first tenure.

Against the backdrop of the legal battle of who has the mandate to serve by the Anambra electorates, the Supreme Court ordered the Independent National Electoral Commission (INEC) not to conduct the gubernatorial elections in the politically volatile state of Anambra state though this was paid a deaf ear for God-knows-why by the commission. Andy Uba, the most favored by the presidency under the then Obasanjo-led administration came to power under the most controversial “people deceive people” circumstances and nobody could say jack. How could you when the Army make it’s intimidating presence concentrated not only at the Awka government house but even the street of Onitsha down to the rural communities prior to the said elections.

The “election” came and passed with all Anambranians feigning “oh yes members” and turning blind to the massive rigging that greeted them to the face. Again Governor Peter Obi pleaded for having on a legal suit stopping the Governor – elect from being sworn in which the court throw out for ambiguous reasons that are only understandable by the clique of senior advocates of Nigeria (SAN’s) Seventeen days after the Apex court sent Andy Uba packing, reinstating Peter Obi to finish his 4-year tenure, the question in contention is “Did Andy Uba ever occupy a seat as high as the governor of Anambra State legally?”

The answer whichever will also raise a pack of unanswered sub questions. Taking “NO” as an answer we ask, why did the Supreme Court kick out the “don’t swear Uba” suit? Didn’t the chief Judge of the state administer the oath of office? Does the Nigerian version of legality vary from the status quo or differ from the real culture (what should be obtained)?

If yes happens to be the answer , then at the end of Governor Peter Obi’s constitutional tenure come 2010, will Andy Uba return to Government house Awka without election? Or will Nigerians be faced with curing the headaches of decoding the political cum legal interpretation of the law?


The earlier we solve this one stitch the better for the nine stitches that we will avert in the future.

Re: Nigerians unmaking Nigeria: United we fall, divided we stand!

This is to let you know that your write-up on the above subject matter is another masterpiece. Like Americans would say to their favorite talk-show host, Sean Hannity, "you are a true Nigerian, Frisky" Substituting Nigerian for American. It may interest you to know that last Sunday after Church service, I referred to Wole Soyinka as a psychopath given his planned appearance before the US congressional hearing on the Nigerian election. There is hope  for Nigeria with writers like you. By the way, I have a confession to make, I have been forwarding you articles to my friends since I discovered you about six months ago. I hope we are still friends, please don't sue me. More grease to your elbow.
